Celem przeprowadzonej przez NIK kontroli postępowań mandatowych i stosowania pouczeń przez funkcjonariuszy straży miejskich oraz egzekwowania grzywien nałożonych przez nich w drodze mandatu karnego było uzyskanie odpowiedzi na pytanie, czy działania z tym związane są prawidłowe i skuteczne. W badaniu posłużono się trzema kryteriami – legalności, gospodarności i rzetelności. Kontrolą objęto lata 2019–2022 i przeprowadzono w województwach podlaskim, kujawsko-pomorskim, mazowieckim, dolnośląskim i świętokrzyskim. Sprawdzono 12 straży, z których pięć to jednostki organizacyjne miast, a siedem funkcjonowało jako komórki organizacyjne będące w strukturach urzędów miast. Artykuł przedstawia ustalenia NIK oraz sformułowane przez nią wnioski.

ABSTRACT
Proceedings Related to Fines, Cautions and Collection of Fines – Activities of Municipal Police
The Supreme Audit Office has examined the proceedings related to fines and cautions imposed by officers of municipal police, and the collection of fines that they impose. It has been established that the activities of the officers of all the audited entities were negligent. Moreover, in almost a half of the audited municipal offices the process of fine collection was incorrect and ineffective. The audit also showed that in the audited period (2019–2021), a decision on imposing a fine or caution depended mainly on the individual approach of an officer as for a given offence, and on the city in which the offence was committed. It was due to the fact that the binding regulations do not define precise rules for application of the so called educational measures (e.g. caution, reprimand, warning). Another reason may be the lack of a supervising body for municipal police that would introduce unified procedures. The behaviour of officers during interventions is regulated with internal procedures adopted for a given entity. And the problem is that these are not always complied with. The article presents the findings of the NIK audit and the conclusions formulated.
