Usuwanie wyrobów zawierających azbest

Rada Ministrów przyjęła 15 marca 2010 r. „Program oczyszczania kraju z azbestu na lata 2009–2032”. Określono w nim cele i zadania (na wszystkich poziomach samorządu terytorialnego), których realizacja umożliwi usunięcie do 2032 r. wyrobów pozostających jeszcze w użytkowaniu. Najwyższa Izba Kontroli przeprowadziła z własnej inicjatywy czwartą już kontrolę dotyczącą utylizacji tego groźnego dla zdrowia materiału. Jej celem było ustalenie, czy w latach 2016–2021 robiono to skutecznie i zgodnie z obowiązującymi regulacjami, a w szczególności z przyjętym Programem. Kontrolą objęto 32 jednostki, w tym pięć urzędów marszałkowskich, trzy starostwa powiatowe, 23 urzędy gmin oraz jeden związek międzygminny. Doboru podmiotów dokonano na podstawie ujętych w Bazie Azbestowej danych dotyczących największej ilości zinwentaryzowanego azbestu lub najniższego wskaźnika materiału usuniętego z terenu danej gminy. Czynności kontrolne przeprowadzono w jednostkach zlokalizowanych na terenie pięciu województw (lubelskiego, łódzkiego, małopolskiego, mazowieckiego i warmińsko-mazurskiego), w których łącznie zinwentaryzowano prawie 4,4 (ponad 50%) z blisko 8,5 mln ton na terenie całej Polski.

Elimination of Products Containing Asbestos – No Option for Removing this Material Before 2032

Due to their harmful impact on health, production of asbestos items and their trade have been subject to various bans. In Poland, they were introduced in the Act of the 19th June 1997 on the ban on using products containing asbestos, while in the whole European Union – in Directives 1999/77/EC and 2003/18/EC, in force since the 1st January 2005. Nevertheless, the resulting bans do not solve the whole asbestos problem in Poland, as millions of tons of asbestos products are still in use, mainly roof surfaces that call for dismantlement and recycling. That is why in 2002 the Council of Ministers adopted “Programme for removing asbestos and products containing asbestos used in Poland”, continued and updated with the “Programme for removing asbestos from the country for the years 2009–2032”, adopted on the 15th March 2010. In 2022, the Supreme Audit Office of Poland conducted, on its own initiative, the forth audit of eliminating asbestos products, which was aimed to establish whether in the years 2016–2021 this was done in an effective manner and in compliance with the binding regulations, especially the Programme adopted. The audit comprised 32 entities, including five regional marshals’ offices (urzędy marszałkowskie), three lower level regional offices (starostwa powiatowe), 23 municipality offices (urzędy gmin), and one inter-municipality association (związek międzygminny). The auditees were selected from the Asbestos Database, related to the largest volume of recorded asbestos, or the lowest level of asbestos removed in the given location. Audit proceedings were conducted at the entities situated in five regions (Lubelskie, Łódzkie, Małopolskie, Mazowieckie and Warmińsko-Mazurskie), where the total of asbestos amounts to almost 4.4 million tons, i.e. over 50 percent out of ca. 8.5 million tons in the whole territory of Poland. The article presents the findings of the audit.
