Informacje uzyskane przez pracowników NIK w związku z wykonywaniem obowiązków służbowych są tajemnicą kontrolerską. W znaczeniu normatywnym jest ona, podobnie jak każda inna tajemnica, prawnie chroniona i opiera się na współistnieniu przesłanki formalnej i materialnej. Pierwsza z nich odnosi się do sposobu wyrażenia woli utajnienia pewnych informacji. W przypadku tajemnicy kontrolerskiej tę wolę wyrażono w ustawie o NIK. Z kolei przesłanka materialna obejmuje trzy zakresy: podmiotowy, przedmiotowy i czasowy. Dotyczą one podmiotów zobowiązanych do przestrzegania tajemnicy, informacji i dokumentów objętych ochroną oraz terminu związania tajemnicą.. W artykule dokonano analizy zakresu przedmiotowego i podmiotowego tajemnicy kontrolerskiej oraz zasad udostępniania informacji nią chronionych.

ABSTRACT
Nature of Audit Confidentiality – Procedures of the Supreme Audit Office
The article contains an analysis of the scope of audit confidentiality and the rules for enclosing information that it protects. The authors focus only on audit confidentiality, which is not equal to other legally protected classified information. Its scope is very broad since it comprises all the information gathered during performance of official duties. However, it needs to be emphasised that access to documents covered with audit confidentiality is not identical to the right to access confidential information, which is exclusively the right of a person guaranteeing to maintain secrecy. Providing access to documents that are protected with audit confidentiality is then possible onlyif the regulations on the protection of confidential information are duly considered, and so are the other relevant regulations on legally protected secrecy.
